Terms of Service

1. Acceptance of Terms

By accessing or using RealSpeak.ai ("the Service"), operated by Leet Publishing, Inc., you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

RealSpeak.ai provides voice AI agent services including real-time emotion detection, phone and web call handling, tool integration, and prosody analytics. The Service is provided on a subscription basis with usage-based billing for minutes consumed.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized access.

4. Free Trial

New accounts receive a 14-day free trial with 50 minutes of usage and 1 agent. No credit card is required for the free trial. After the trial period, you must subscribe to a paid plan to continue using the Service.

5. Billing and Payments

Paid plans are billed monthly. Usage beyond your plan's included minutes is charged at $0.12 per minute. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days notice. For our complete refund policy, see Section 11 below.

6. Acceptable Use

You agree not to: use the Service for unlawful purposes, transmit malicious code, attempt to gain unauthorized access to our systems, use the Service to make harassing or fraudulent calls, or exceed rate limits. We reserve the right to suspend accounts that violate these terms.

7. Intellectual Property

The Service, including its design, code, and documentation, is owned by Leet Publishing, Inc. You retain ownership of your data, configurations, and custom agent prompts. You grant us a license to process your data solely to provide the Service.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Leet Publishing, Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

9. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease and your data may be deleted after 30 days. We may terminate or suspend your account immediately for violations of these terms.

11. Refund Policy

We want you to be satisfied with RealSpeak.ai. Our refund policy is as follows:

• Free Trial: No charge is incurred during the 14-day free trial. You may cancel at any time during the trial period at no cost.
• Monthly Subscriptions: You may cancel your monthly subscription at any time. Your access will continue until the end of the current billing period. No prorated refunds are issued for partial months.
• Annual Subscriptions: A full refund is available within the first 14 days of your initial annual purchase. After 14 days, you may cancel at any time, but no refund will be issued for the remaining term of the subscription.
• Overage Charges: Charges for usage beyond your plan's included minutes are non-refundable, as they represent consumed usage.
• How to Cancel: You may cancel your subscription through your dashboard at Settings > Billing, or by emailing support@realspeak.ai.
• Refund Processing: Approved refunds will be processed within 5–10 business days to your original payment method.
• Exceptions: Refunds may be issued at our sole discretion for documented service outages exceeding 24 consecutive hours.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved within 30 days of written notice, it shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in the State of Delaware, United States.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Small Claims Exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Indemnification

You agree to indemnify, defend, and hold harmless Leet Publishing, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your misuse of the Service.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Leet Publishing, Inc. regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
